Terms of the snap2eyes Free Trial Offer for the Tristitial
To help businesses, publishers, and bloggers test out the Internet marketing capabilities of the snap2eyes Tristitial, snap2eyes is offering to create a Tristitial at no charge (the "Free Offer") for a limited time to be determined at snap2eyes's sole discretion and subject to the terms and conditions set forth herein.
The Free Offer does not include any online ad space, which must be purchased separately by you from the publisher on whose web site you wish to display the Tristitial created pursuant to the Free Offer (the "Free Tristitital"). snap2eyes makes no representations or warranties about the quality, the usability or the interoperability of the Free Tristitial sent to you, or anything else associated with the Free Offer or any related service, and snap2eyes expressly disclaims any and all liability associated therewith.
You keep, deploy, and otherwise use any Free Tristitial and use any related service entirely at your own risk. By submitting your request to receive a Free Tristitial, you expressly agree to indemnify snap2eyes for any losses or damages of any kind that snap2eyes may suffer as a result of any claim, whether threatened or actual and whether brought by you or any third party, which claim arises out of or is related to the Free Offer or the Free Tristitial. You understand that the above disclaimers and indemnification are an essential part of the bargain contemplated by the Free Offer, and that snap2eyes would not provide the Free Offer to you but for your agreement to the above disclaimers and indemnification.
snap2eyes reserves the right, in its sole and absolute discretion, (a) to refuse to honor the Free Offer with respect to any particular customer and (b) to discontinue the Free Offer at any time. snap2eyes does not guarantee that all Free Offer requests will be fulfilled or even responded to, although snap2eyes will endeavor to respond to a Free Offer request within 48 hours of the time such request is made. snap2eyes provides no technical support whatsoever in connection with the Free Offer, any related Tristitial, any related ad deployment, or otherwise. Your participation in the Free Offer creates no further obligation on the part of snap2eyes, nor any agency, partnership, or other business relationship between you and snap2eyes.
By requesting a Free Tristitial, you expressly grant to snap2eyes the right, in perpetuity, to (a) display such Free Tristitial on any snap2eyes web site, (b) provide such Free Tristitial to potential customers of snap2eyes that request a sample Tristitial, (c) to submit such Free Tristitial to online advertising competitions and/or online publications that wish to showcase noteworthy campaigns, and (d) to give appropriate credit to snap2eyes should you decide to submit the Free Tristitial to any online advertising competition.
